How did oversight happen?

In a separate interview, Marquez ventured a guess on why the PAL case ended up in the tribunal's Second Division, and not the Special Third Division.

Marquez said the justice in charge of the PAL case could have been a regular member of the Second Division while also being assigned to the Third Division.

"Since he's member in charge, he drafted that resolution to be circulated to the members of the Special Third Division pero baka naibigay niya dun sa clerk of court ng Second Division tapos sinabi na 'pa-agenda mo na yan para matapos na yan,'" he told Mornings@ANC.

Compounding the problem, he said, was that members of the Second Division that ruled on the 2nd MR were not regular members of the division.

"At that time this case was included in the agenda of the Second Division, one inhibited, 2 regular members were on leave. And therefore for that division to be able to resolve cases pending in that division, they will have to be joined by specially designated members," Marquez said.
