Witnesses Wanted: Toronto Police Service Application of Domestic Violence Manual Alleged to Violate s.15 of Charter

I am counsel for the plaintiff in an action against the Toronto Police Services Board and various officers in a claim alleging the violation of his equality rights under section 15 of the Canadian Charter of Rights and Freedoms for the manner in which officers from this service dealt with a complaint of domestic violence from his former spouse.(Superior Court of Justice File No.06-CV-313259PD3)

The Plaintiff, Mr. Peter Kellman, was charged with assualt and uttering a threat to commit seriously bodily harm and his spouse was not charged criminally even though she informed the police that she struck Mr. Kellman at least twice first. Mr. Kellman was placed in handcuffs and removed from his home by police. He was held in custody for a bail hearing. Mr. Kellman was prosecuted from April 27th, 2003 and subject to a recognizance until July 28th, 2004 when the charges against him were withdrawn.

The claim asserts a discriminatory application of the law by the police defendants as between Mr. Kellman - a man of African-Canadian racial background and his former spouse a woman of European racial background.
